Welcome to Pix ("App"), operated by 8372128 Canada Inc. ("Company", "we", "us", or "our"). By downloading, installing, or using Pix, you agree to these Terms of Use ("Terms"). If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use this App. If you are under 18, you must have permission from a parent or legal guardian. By using the App, you represent that you meet these requirements.

2. Description of Service

Pix is an AI-powered camera application that provides real-time photography coaching suggestions. The App analyzes camera viewfinder content and provides suggestions to help users improve photo composition, framing, and lighting.

AI Disclaimer: Pix uses artificial intelligence to generate coaching suggestions. These suggestions are generated by machine learning models and are provided for informational purposes only. They do not constitute professional photography advice. Results may vary, and we do not guarantee that following suggestions will result in satisfactory photographs.

3. Subscriptions and Payments

Pix offers both free and paid subscription tiers:

Free Tier: Limited number of coaching sessions
Day Pass: 24-hour unlimited access
Monthly Subscription: Recurring monthly billing
Annual Subscription: Recurring annual billing

4. Cancellation and Refund Policy

Cancellation: You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Upon cancellation, your subscription will remain active until the end of the current billing period. You will not be charged for the next billing cycle.

Refunds: We do not provide refunds for partial billing periods. If you cancel mid-cycle, you will retain access until the end of your paid period but will not receive a prorated refund. Refund requests for exceptional circumstances may be submitted to the respective app store.

5. Acceptable Use

You agree not to use the App to:

Violate any applicable laws or regulations
Photograph subjects without their consent where required by law
Create, store, or distribute illegal content
Attempt to reverse engineer, modify, or tamper with the App
Use the App for any commercial purpose without our permission

6. Intellectual Property

The App, including its AI models, design, code, and content, is owned by 8372128 Canada Inc. and protected by intellectual property laws. Your photos remain your property. We claim no ownership over photographs you take using the App.

7. Limitation of Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are not responsible for missed photo opportunities, unsatisfactory photographs, or any consequences of following or not following AI suggestions
We are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the App
AI coaching suggestions may be inaccurate or unsuitable for your specific situation
Our total liability shall not exceed the amount you paid for the App in the 12 months preceding any claim

8. Indemnification

You agree to indemnify and hold harmless 8372128 Canada Inc. and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms in the App or on our website with an updated effective date. Continued use of the App after changes constitutes acceptance of the new Terms.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our discretion.

11. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario, Canada.
